Biography
Jacky Beda is a native of Miami, Florida. He earned his undergraduate degree from Yeshiva University, where he majored in Political Science and played Division III NCAA men's basketball, before attending The George Washington University Law School. In Washington, D.C., he clerked for the United States Department of Justice and for the Office of the Attorney General for the District of Columbia. Mr. Beda graduated with High Honors in 2017 and was named a Thurgood Marshall Scholar. He began his legal career as a prosecutor at the State Attorney’s Office for the Seventeenth Judicial Circuit, where he tried felony cases from inception through verdict as first-chair trial counsel, and subsequently practiced state and federal civil litigation as an associate at a defense firm. He joined Zarco Einhorn Salkowski, P.A. in April 2021.
Mr. Beda’s practice centers on franchise and commercial litigation, with an emphasis on representing franchisees and business owners. On the franchise side, he handles disputes involving FTC Franchise Rule and franchise disclosure document (FDD) violations, including Item 19 financial-performance representations, along with rescission, wrongful termination, post-termination noncompete and de-identification issues, territorial and area-development disputes, and the purchase, sale, and transfer of franchises. He represents clients across a range of franchise systems in litigation, arbitration, and pre-suit demand and negotiation.
His broader commercial practice includes business-partnership, shareholder, and closely-held-company disputes—including derivative actions and claims for breach of fiduciary duty and wrongfully withheld distributions—as well as breach-of-contract, fraud, and tortious-interference claims; trademark and Lanham Act disputes; commercial-lease dispute and real-estate disputes; and disputes with municipal and county governments over land use, permitting, code enforcement, and threatened demolition, including takings claims. He also pursues post-judgment collection and proceedings supplementary, including under alter-ego and fraudulent-transfer theories.
Mr. Beda has substantial trial and hearing experience, including first-chair examinations in multi-day non-jury trials, final arbitration hearings, and evidentiary hearings, and he has handled appellate matters, including before Florida's Third District Court of Appeal. He litigates in state and federal courts and in domestic and international arbitration, primarily in Florida but in venues nationwide, and represents clients in both English and Spanish.
