Robert M. Einhorn is a Partner at Zarco Einhorn Salkowski, P.A., a nationally recognized Franchise Law, Business Trial Law, and Complex Commercial Litigation firm headquartered in Miami, Florida. Widely respected as one of the nation's leading franchise trial lawyers, Mr. Einhorn is known for his analytical legal judgment, meticulous preparation, and extensive courtroom experience. For more than three decades, he has represented franchisees, multi-unit franchisees, franchisee associations, dealers, distributors, licensees, and business owners in high-stakes franchise and complex commercial litigation, arbitration, mediation, and other sophisticated business disputes involving hundreds of franchise systems across the hotel, restaurant, retail, automotive, and service industries.

Mr. Einhorn's unique combination of legal, accounting, and business experience enables him to provide practical, strategic counsel that reflects both the legal and business realities facing his clients. He earned a Bachelor of Business Administration from the University of Wisconsin-Madison, where he dual-majored in Accounting and Risk & Insurance, and received his Juris Doctor from the University of Miami School of Law. As both an attorney and an accountant, he brings a distinctive perspective to complex commercial and franchise disputes involving financial, operational, and strategic business issues.

Following law school, Mr. Einhorn practiced with a prominent Florida litigation firm, where he gained extensive experience handling sophisticated civil and criminal litigation in state and federal courts nationwide. He is admitted to practice before numerous federal courts and has represented clients in courts and arbitration forums throughout the country.

Mr. Einhorn joined Robert Zarco in January 1994 and has helped build one of the nation's leading franchise litigation practices. Throughout his career, he has represented clients in complex franchise and commercial disputes involving wrongful termination, fraud, encroachment, contract claims, business torts, and other high-stakes litigation. He also works closely with franchisee associations throughout North America, advocating for fairness in franchising and stronger franchisor-franchisee relationships.

A recognized leader within the franchise legal community, Mr. Einhorn has devoted more than three decades to advancing franchise law through writing, speaking, and professional service. He has been actively involved with both the American Association of Franchisees and Dealers (AAFD) and the American Bar Association (ABA) Forum on Franchising, serving on the AAFD's Fair Franchising Standards Committee, frequently speaking at the ABA Forum on Franchising's Annual Meeting, and contributing to many of the profession's leading publications.

His publications and editorial work reflect his longstanding leadership within the ABA Forum on Franchising. Mr. Einhorn served as a contributing author to the ABA's Fundamentals of Franchising, Fourth Edition, Co-Editor of the ABA's Franchise Litigation Handbook, Second Edition, and co-author of "Personal Liability for Franchise Sellers," published in the Franchise Law Journal (Vol. 43, No. 4, Fall 2024). He has also served as both an author and editor of the Franchise Law Journal. Mr. Einhorn is presently serving as the Co-Chair of the ABA Franchise Forum’s Annual Conference which is being held in Toronto on October 14-16, 2026.

Mr. Einhorn has earned national recognition for excellence in franchise law and commercial litigation. He is ranked by Chambers USA and recognized in The Best Lawyers in America®, including being named "Lawyer of the Year" for Franchise Law in 2012 and 2017. He has also received the American Association of Franchisees and Dealers' Lifetime Achievement Award in Total Quality Franchising (2025). He has been selected to Super Lawyers, inducted into the Franchise Times Legal Eagles Hall of Fame and recognized among the Very Best U.S. Attorneys. He also earned one of the Top 50 Bench Awards in the United States (2023).
